Terms of Service
In this agreement we refer to you, the purchaser as "you" or "your". Winetopia events are organised by Lemongrass Productions Ltd and our shop is facilitated by Magic Gourd Ltd (together "us", "we" or "our").
These terms and conditions are intended to keep Winetopia a safe place to buy wine and facilitate the purchase of event tickets. By using our website, you acknowledge that you have read, understood and agree to the terms and conditions. These terms and conditions were last updated 19/11/2025.
This agreement applies to all purchases from the Winetopia website and we reserve the right to change these Terms of Service from time to time.
Event Tickets
Please read these Terms and Conditions carefully before purchasing tickets. By purchasing tickets or attending the event in any other way you are agreeing to be bound by these Terms and Conditions.
- Due to their wine-centric nature Winetopia events are strictly R18. Minors cannot be admitted.
- Tickets are non-refundable and non-exchangeable. If an event is cancelled, or a refund is required by law, liability is limited to refunding the ticket price only. All other fees and charges are non-refundable.
- Tickets will be electronically supplied by email on receipt of full payment.
- Should your tickets be lost or damaged, any replacement tickets will be issued at our sole discretion and we reserve the right to charge for the replacement of any tickets issued. We will not offer refunds under any circumstances. We may not be able to replace tickets where seating is not allocated.
- Advertising of tickets and ticket prices is subject to availability and it is not unusual for ticket categories to sell out.
- Event entry tickets (General Admittance or Premium, including Presale or Early Bird Tickets) incur a $2 per ticket fee. All orders include a 2.8% fee to cover credit/debit cards and administrative costs.
- By purchasing tickets or attending the event in any other way you are consenting to the use of your image taken via photo or video, including images taken by us or shared by you, to be used by us for promotional purposes.
- Professional cameras and video recorders (film, digital or otherwise), audiotape recorders and all other recording devices are only to be utilised with prior written consent and must adhere to our onsite instructions.
- The serving and consumption of alcohol is subject to our Alcohol Management Policy, liquor licensing laws governed by local authorities and this includes the Sale and Supply of Alcohol Act 2012. Admission may be refused to anyone who arrives at a Winetopia event showing signs of intoxication.
- If the Event is cancelled, prevented, postponed or abandoned, in whole or in part, for any reason whatsoever that is beyond the Organiser’s control, including, without limitation, by reason of fire, flood, earthquake, epidemic or pandemic or similar event, state of emergency, Act of God, warlike hostilities, and Act of Parliament, action by government, regulation or direction or any strike or industrial action, disruption to the power supply, (together “Force Majeure Event”) then the Organiser shall not be liable to any person for any expenditure, liability, loss (including consequential loss incurred) or refunds in any way whatsoever and howsoever arising. If a postponement date can be arranged then your tickets will be valid for the new dates but no obligation is assumed by us for this.
- We reserve the right to refuse admission with reasonable cause, or expel any person who in our opinion is disrupting other guests or workers.
- We reserve the right to refuse admission if valid identification for tickets is not provided.
- We reserve the right to refuse admission where tickets are lost or damaged, or tickets are not purchased through our official channels or website (www.winetopia.co.nz).
- We reserve the right to withdraw, replace or substitute presenters, artists, or amend the programme, prices and/or seating arrangements.
- Admission is at Ticket Holders own risk. We will not be held liable for any loss, injuries or damages sustained at this event including damage, theft or losses to property.
- Your personal information is held by us and will not be sold or passed on to any other party unless you have given the express consent to do so by opting in to hear from them. If you have opted to receive news from us when creating your account with us, you will be sent regular email newsletters and can opt out of these at any time. From time to time we may need to share your details with 3rd party agents for the express purpose of facilitating our event management services. This may include but not be limited to ticketing agencies or other service providers.
- Reselling or distributing tickets purchased on our website without our express permission is prohibited.
- If you wish to close your Winetopia account and have us delete any personal data stored, you can email us on admin@winetopia.co.nz to make this request and we will do so, provided the erasure does not contravene any applicable laws.

Event Hygiene Practices
We will have hand sanitiser available throughout the events, and hand washing facilities at the event bathrooms. If you or anyone in your party is feeling unwell or displays flu-like symptoms please do not attend the event. Ticketholders feeling unwell with possible symptoms of Covid-19 can send us a message and we will offer a credit towards a future event or at our discretion, provide a refund.
Product Purchase Terms
- Under the Sale and Supply of Alcohol Act 2012, alcoholic beverages can only be sold or supplied to persons aged 18 years of age or over.
- Winetopia encourages the legal and responsible consumption of alcoholic beverages.
- When purchasing products on the website you confirm and acknowledge that:
- You are legally entitled to purchase alcohol and that you can provide sufficient evidence of that entitlement on request (e.g. NZ Driver’s Licence or Passport) prior to or upon delivery of the products.
- All information supplied by you to us is true and correct at the time you make any purchase on the website.
- Notwithstanding the above, we may refuse to accept your order at our sole discretion.
- We may disclose your information to your bank and Credit Card Company and for the purposes of any debt recovery proceedings we may issue against you.
- We may restrict your ability to purchase products via the website by imposing a credit limit on your account.
Product Availability
- All products are sold subject to their availability. Promotional items may be limited as to quantity. We shall not be responsible for our inability to supply products to you where they are not presently available or where our stock of the relevant product(s) has been exhausted.
Price
- Prices quoted on our website are inclusive of GST. You must pay us the full price quoted on the website at the time the order is submitted. Prices are given in New Zealand dollars.
- We reserve the right to vary our prices without notice. No adjustments are made if the price of a product increases or decreases between the time the order is submitted and the time the product is delivered.
- In the event that computer error results in a material misstatement of the price of your order we may, prior to your receipt of the order or at any time thereafter, require that you pay us the difference between the amount actually paid by you in respect of your order and the correct amount payable.
- In the event that we become aware of any misstatement prior to delivery, we will make reasonable endeavours to contact you and advise you accordingly. You may elect to cancel your order to the extent of the misstatement.
Delivery & Freight
- Product prices are quoted exclusive of transit costs. Any courier or handling charges in relation to your order will be notified to you at the time you place your order and be added to the price. Standard delivery fee within mainland New Zealand is:
$6.50 per case (6 bottles) to a city/residential address
$9.50 per case (6 bottles) for a rural address
- If you order multiple cases of wine then the shipping cost per case will come down and this will be shown in the final stages of check out. We ship to most parts of New Zealand but unfortunately may not be able to deliver to some locations. Please note your shipping fee may reflect multiple courier fees and your products may turn up in separate deliveries.
- Delivery will usually be made within 3-5 business days. If there is a lead time or delay, we will contact you to confirm delivery times.
International
- We do not facilitate delivery outside of New Zealand through this website but please get in touch with us on +64 9 3779 224 or email at admin@winetopia.co.nz if you would like to discuss international delivery options.
Legal
- Due to licensing laws delivery of sales can only be made between 6am and 11pm and cannot be made on Good Friday, Easter Sunday, Christmas Day and before 1pm on Anzac Day. No orders will be shipped until payment has been received. We are not responsible for any failure to deliver, or delay in delivery caused by any event outside of our reasonable control.
Returns
- Once you have placed an order on this website the order is final and cannot be cancelled. However, if for any reason, you are not happy with your order or simply find the wine is not to your taste, we will replace any unopened bottles with another product or credit your account. We will arrange a courier to collect the unopened goods for returning. This return must be requested within 1 month of purchase.
- If your order has been packed incorrectly (oops!) and is not what you have been invoiced for, we are happy to work this out for you. Please note that packing errors must be reported within 48 hours of delivery.
- If your delivery has been damaged in transit, we will replace it for you. Advice regarding order shortages or damage in transit must be given to our customer service team no later than 48 hours after you receive the products.
- We insure our products up to the point where they are delivered to your address. We are not responsible for damage or theft to goods beyond this point.
Payment Terms & Warranties
- You must pay us the full price quoted on the website at the time the order is submitted.
- We will send all invoices and notices required under this agreement to the address (postal, fax or email) that you have nominated as your preferred method of contact. It is your responsibility to ensure that you keep us informed of any changes to your contact details.
- We hereby represent that we have the right to sell the products listed on our website and You have the right to undisturbed possession of these products after purchasing.
Site Content and Intellectual Property
- We own, control or have the right to use and provide the website and all content on the website, including text, images, articles, photographs, illustrations, audio and video clips. You may electronically reproduce and store the content of the website solely for the purposes of viewing, using the services or saving website content, for your own personal use. You may not display or distribute the content of any part of the website or its content in public, including any reproduction in any form on the Internet, without our express permission.
- Any infringement of our intellectual property rights will be fully enforced under New Zealand law.
Consent to Receive Electronic Messages
- You agree by registering on this website that you expressly consent to your inclusion in our direct marketing database and accept that you may, as a result, receive regular electronic communications and promotional communications from us. You have the right to ask us at any time to stop sending electronic communications and promotional offers to you.
Use of Your Information
- During the term of this agreement your use of the website will generate certain information that will be recorded electronically by us. Information of this type may include, for example, your IP address, your usage statistics, etc. We will also record your contact details, credit information and any related personal details that you supply or that we obtain independently.
- You acknowledge that we, our employees, carriers, contractors and agents may use or disclose any of the information identified in the previous paragraph for purposes connected with the supply of the services to you. Examples of purposes connected with supply include, for example: administration of your account with Winetopia or on the website; keeping you up to date with new offers/changes at Winetopia; sharing with contractors to enable you to use or facilitate your use of the website.
- You may at any time make a written request to see any personal information that we hold or to ask us to correct any mistakes in that information.
Jurisdiction
- This website is provided for use by New Zealand residents. We make no representations that the website complies with the laws of any other country. These terms shall be governed by and construed in accordance with the laws of New Zealand and shall be subject to the exclusive jurisdiction of the New Zealand courts.
Amendments
- We may change the terms of this agreement by sending you notice (“amendment notice”) to that effect by your preferred contact method and supplying you with the amended agreement. The agreement, as modified, will take effect from the date stated on the amendment notice but no later than 30 days following the date that we send the amendment notice.
